CONCERNING
DELEGATION OF AUTHORITY TO MAKES AND SIGNS DECREE OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE ON BEHALF OF DIRECTOR GENERAL OF CUSTOMS AND EXCISE FOR OBJECTION IN CUSTOMS AND EXCISE TO DIRECTOR OF RECEIVING AND REGULATIONS AND TO HEAD OF PRIMARY SERVICE OFFICE OF CUSTOMS AND EXCISE

DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

a. based on organization and procedures certainty, as decided in Regulation of the Minister of Finance No. 131/PMK.01/2006 and Regulation of the Minister of Finance No. 68/PMK.01/2007, Director General of Customs and Excise implements task and function in investigation for objection of stipulation in customs and excise,

b. that, to reform procedures in Minister of Finance environment, has decided Outstanding Service Standard Operating Procedure (SOP) to solve objection in Customs and Excise at Customs and Excise Primary Service Office;

c. that, to optimize implementation of task and function, and implementation of above Outstanding Service SOP, it is necessary to delegate authority on behalf of Director General of Customs and Excise for objection in Customs and Excise, to Director of Receiving and Regulations and to Head of Primary Service Office of Customs and Excise;

d. that, based on considerations as intended above in paragraphs a, b, and c, it is necessary to stipulates Decree of the Director General of Customs and Excise concerning Delegation of authority on behalf of Director General of Customs and Excise, to makes and signs Decree of the Director General of Customs and Excise for objection in Customs and Excise, to Director of Receiving and Regulations and to Head of Primary Service Office of Customs and Excise;

In view of:

1. Law No. 10/1995 concerning Customs (Republic of Indonesia Statute Book No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 (Republic of Indonesia Statute Book No. 93/2006, Supplement to Statute Book No. 4661);

2. Law No. 11/1995 concerning Excise (Republic of Indonesia Statute Book No. 76/1995, Supplement to Statute Book No. 3613) as amended by Law No. 39/2007 (Republic of Indonesia Statute Book No. 105/2007, Supplement to Statute Book No. 4755);

3. Regulation of the Minister of Finance No. 131/PMK.01/2006 concerning Organization and Working Procedures in Ministry of Finance;

4. Regulation of the Minister of Finance No. 68/PMK.01/2007 concerning Organization and Working Procedures of Vertical Sections in Directorate General of Customs and Excise;

5. Decree of the Minister of Finance No. 380/KMK.05/1999 concerning Procedures to propose objections in Customs and Excise;

HAS DECIDED:

To stipulate:

DECREE OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING DELEGATION OF AUTHORITY TO MAKES AND SIGNS DECREE OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE ON BEHALF OF DIRECTOR GENERAL OF CUSTOMS AND EXCISE FOR OBJECTION IN CUSTOMS AND EXCISE TO DIRECTOR OF RECEIVING AND REGULATIONS AND TO HEAD OF PRIMARY SERVICE OFFICE OF CUSTOMS AND EXCISE

FIRST:

In this Decree of the director general of customs and excise, Objection in Customs and Excise refers to written objection to customs and excise official stipulation, covering:

SECOND:

Authority on behalf of Director General of Customs and Excise to makes and signs Decree of the Director General for objection in customs and excise as intended in FIRST PARAGRAPH, is delegate to:

THIRD:

to instruct Director of Receiving and Regulations and Head of Primary Service Office to implement authority at SECOND PARAGRAPH with responsibility and should send implementation report periodically to Director General of Customs and Excise.

FOURTH:

By this Decree of the Director General of Customs and Excise comes into effect, Decree of the Director General of Customs and Excise No. KEP-91/BC/2005 concerning Delegation of Authority to Signs Decree of the Director General of Customs and Excise on behalf of Director General to Director of Receiving and Regulation for Objection in Customs and Excise, is declared void and null.

FIFTH:

If in the future there is any mistake in this Director General Decision, it will be amended.

SIXTH:

This Decision shall come into force on the date of stipulation.
